We agree to indemnify and save Baker Recovery, Inc. harmless from and against any and all claims, including but not limited to court costs, reasonable attorney fees and other expenses of litigation including those arising from damage done to the collateral, except for unauthorized or unlawful acts of your firm. Baker Recovery, Inc. will not be held responsible for damages due to defective or aftermarket parts and accessories. This indemnification is granted as consideration for Baker Recovery, Inc. acting as our agent. It is agreed that this contract is executed within your state and that the laws of your state shall be applicable. When there are two states involved, the laws of both states may be applicable. We agree to provide written notice via email to repo.updates@bakerrecovery.com of any and all holds, closes or cancellations of our orders in order to prevent wrongful repossessions. We understand a phone call does not constitute formal notice under this agreement, and we agree to be responsible for all fees due Baker Recovery for repossessions and/or takeback or any litigation arising from such recovery activities.
